Terms of Service

1. Acceptance of terms

By accessing or using Race for Sale ("the Platform") you agree to these Terms of Service. If you are using the Platform on behalf of a business, you confirm that you have authority to bind that business to these terms.

We may update these terms. We will notify account holders of any material change by email at least 15 days before it takes effect; if you do not agree with the change, you may close your account before that date.

2. Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at contact@raceforsale.com if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or are otherwise harmful to other users or the Platform.

3. Seller terms

By submitting a listing, you confirm that:

• You are the legal owner of the vehicle or item, or are authorised to sell it on behalf of the owner.
• All information in the listing is accurate and complete to the best of your knowledge. Misrepresentation of provenance, eligibility status, mileage, or condition is grounds for immediate removal and may expose you to civil liability.
• Any FIA, MSUK, ASN or other regulatory documents referenced in the listing are genuine, in date, and in your possession.
• You will respond to verified buyer enquiries within 3 business days.
• If you accept an offer outside the Platform after a buyer has made contact through the Platform, nothing further is owed to Race for Sale. You only pay to publish a listing.

Listing fees are non-refundable once a listing has been approved and published. If a listing fails editorial review, a full refund is issued.

4. Buyer terms

Race for Sale is a marketplace. We are not a party to any transaction between buyers and sellers. We do not guarantee the accuracy of listings, the condition of vehicles, or the title status of any item listed.

Our editorial review process reduces (but does not eliminate) the risk of misleading listings. Buyers are strongly advised to conduct independent inspection and legal due diligence before purchase.

5. Fees and payments

Listing fees are set out on our Pricing page. During our launch period, Standard listings may be free. Featured and Premium placements are awarded editorially and are not sold at checkout. When paid plans are enabled, they are charged via Stripe Checkout. Payment is by card through Stripe. We do not currently offer SEPA direct debit or NET 14 invoicing as a self-serve checkout option.

For card payments, your card is authorised at submission but charged only after editorial approval. If your listing is declined, no charge is made and any authorisation is released.

Listing fees shown at checkout are tax-inclusive. Stripe automatic tax may adjust the tax breakdown for your billing country; the amount you authorise is the final price shown at checkout. Business sellers may enter a VAT ID at checkout where Stripe supports it.

If you are a consumer resident in the EU, you have a statutory right to withdraw from a paid listing within 14 days. Publication begins as soon as we approve your listing, so by submitting it for review you ask us to start the service within that period and you acknowledge that your right of withdrawal lapses once the listing is published. Until it is published, you may cancel for a full refund by emailing contact@raceforsale.com.

6. Prohibited listings

The following are not permitted on the Platform:

• Stolen vehicles or vehicles with outstanding finance that would transfer to the buyer.
• Items that are counterfeit, replicas sold as originals, or vehicles with falsified documentation.
• Anything that is illegal to sell in the seller's jurisdiction or the buyer's jurisdiction.
• Listings that materially misrepresent competition history, eligibility, mileage, hours or condition.

Categories available on the Platform (including performance and classic road cars, drives and experiences, jobs, property, clubs and memorabilia) are governed by the category rules shown in the listing form. We may remove listings that fall outside those rules or that we reasonably consider harmful to buyers.

7. Limitation of liability

To the maximum extent permitted by applicable law, Race for Sale shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising under these terms shall not exceed the listing fee you paid for the relevant listing, or €500, whichever is greater.

8. Governing law

These terms are governed by the laws of Belgium. Any dispute shall be subject to the exclusive jurisdiction of the courts of Belgium, save that consumers in EU member states may also bring proceedings in the courts of their country of residence.

9. Listing visibility

Plan selection (Standard, Featured, Premium, Auction) and editorial awards affect where and how prominently listings appear. During launch, Standard may be free, and Featured and Premium may be awarded editorially. See our How ranking works page for a plain-language explanation of how ranking works.

10. Auction listings

An auction listing is a presentation format with a published end time. Race for Sale does not run the bidding, does not hold or escrow funds, and does not settle the sale. Bids are placed, accepted and honoured off-platform between the buyer and the seller on whatever terms they agree.

Any estimate range or buyer's premium shown on an auction listing is information the seller supplied about their own sale. We do not verify it, we do not collect it, and it forms no part of any contract between you and us. When the published end time passes, the listing stops being active on the Platform; that has no bearing on whether a sale happened or on what either party owes the other.

Everything in section 4 applies to auction listings: we are not a party to the transaction, and independent inspection remains the buyer's responsibility.
